Recent Law Changes
Civil Monetary Penalties Adjusted for Inflation
Previously, civil monetary penalties were adjusted annually based on inflation. However, this new rule reflects that there will be no cost-of-living adjustment for these penalties in 2026. This change affects entities and individuals who might face civil monetary penalties from the Board. The rule takes effect immediately as of May 5, 2026.
New Controlled Substances Added to Schedule I
This law adds four new synthetic substances—4F-MDMB-BUTICA, ADB-4en-PINACA, 5F-EDMB-PICA, and MMB-FUBICA—to Schedule I of the Controlled Substances Act. Before this change, these substances were not regulated under federal drug laws. Now, anyone who manufactures, distributes, imports, exports, conducts research or instructional activities with, or possesses these substances will face administrative, civil, and criminal sanctions. This law takes effect immediately.
Extension of Import Restrictions on Afghan Cultural Artifacts
This amendment extends emergency import restrictions on certain archaeological and ethnological material from Afghanistan. Previously, these restrictions were set to expire soon but are now extended until April 28, 2029. The regulations have been updated to align with other cultural property restrictions imposed by the U.S. Customs and Border Protection (CBP). This change affects importers of Afghan artifacts who must comply with these restrictions or face penalties.
